Digital ID card user terms and conditions
Last updated 08-05-2023
1. Background
1.1 These terms of use (the "Terms and Conditions") apply between your bank (the "Bank") and you ("You", "Your") for the use of the digital ID card service (the "Service") provided in the BankID app (the "App").
1.2 These Terms are time-limited and are valid until you have entered into an agreement with the Bank applying to the use of the Mobile BankID Service (the Agreement). After this, the Agreement will regulate your use of the Service.
1.3 By using the Service and thereby accepting the Terms and Conditions, you confirm that you have read them and the information they contain.
1.4 Please read the Terms and Conditions carefully as they contain important information about your rights and obligations when using the Service.
2. Service
2.1 The Service provided via the App enables you to use a digital ID document ("Digital ID card”) instead of your physical ID to identify yourself with third parties. You gain access to the Service by having a personally-issued Mobile BankID from the Bank in accordance with the Bank's Mobile BankID terms and conditions.
2.2 The Service is personal to you and in order to use the Service the App must be installed on your mobile phone, tablet or a similar device with a connection to the Internet, to which your Mobile BankID is connected (the "Device"). The Service requires Mobile BankID to be installed on the same device.
3. Terms and Conditions for use of the Service
3.1 Just like Mobile BankID, the Digital ID card/Service is a document of value. The Service (including the Device on which the App is installed) must therefore be handled in the same reassuring manner and in accordance with the conditions that apply between you and the Bank for the use of Mobile BankID. This means that your obligations and responsibilities for Mobile BankID also apply to the Service.
3.2 By accepting the Terms and Conditions, you are confirming that you are the person you claim to be, that you are over 18 years of age or have a guardian's permission if you are a minor, and that the information you provide to the Service is correct.
3.3 You are responsible for how your personal Digital ID card is used, including the risk of your Digital ID card being used without authorisation by someone other than you.
3.4 You are also obliged to comply with the terms and conditions of the Service and the general terms and conditions applicable to the use of Mobile BankID.
3.5 You are prohibited from using, or in any way facilitating or supporting others in the use of the Service in any illegal, fraudulent or abusive manner or in any manner that infringes on the intellectual property rights of anyone. In addition, you may not:
use the Service for activities, including storing, distributing or otherwise making available content that is illegal, that violates the rights of others, or that may be harmful or inconvenient to others, including acting in a threatening, stalking, fraudulent, degrading or otherwise ethically questionable manner.
copy, distribute, modify, reverse compile, decompile, disassemble or otherwise determine the source code of the Service or any part thereof, or create adaptations of the Service and the Service's features. In particular, you may not create copies, images or adaptations of the Digital ID Card or create a representation that purports to be or resembles a valid Digital ID Card.
violate or attempt to violate the security or integrity of the Service, e.g. by transmitting malicious code, malicious software, viruses, trojans or which may otherwise damage or have a negative effect on the Service.
access the Service in a fraudulent or unauthorised manner, including bypassing the Service's protocols and access controls and to access or authorise someone to access the Service from an embargoed country.
copy core products or services offered by us.
3.6 The Bank reserves the right to limit, revoke or block your access to the Service at any time if the Bank suspects or has evidence that you have used the Service in violation of the Terms and Conditions, other applicable terms, applicable legislation or market practice, or if you act in a manner which risks causing damage to the Bank, users or others.
4. Period of the Agreement
4.1 The Terms and Conditions apply from the day you start using the Service and accept the Terms and Conditions. The Terms and Conditions are terminated by the Service being deleted or removed from your device, the validity period of your BankID, expiry of your scanned passport or national ID card or if the Bank restricts, revokes or blocks your BankID or your access to the Service in accordance with the Terms and Conditions.
